Gustavo Diaz was arrested in Fort Worth on Monday for a second driving while intoxicated offense in seven days. The new charges stem from a Sunday morning collision on Interstate 35W that left two people trapped in a flipped SUV.

Police report that Diaz, 34, struck the rear of a southbound SUV just before 1:30 a.m. near the intersection of I-20 and Altamesa Boulevard. The impact drove both vehicles toward the highway wall, causing the SUV to roll over. Two occupants were trapped inside the upside-down vehicle until other drivers arrived to assist.

Claudia Luna, one of the victims, was found unconscious with a serious head injury. She described having an open wound on the top of her head and bruises across her body. Luna was released from the hospital and is now recovering with her family. The second passenger remains in critical condition at the hospital with a broken leg. No further updates have been provided on that passenger's status.

Investigators said Diaz attempted to flee the scene after the crash. Witnesses provided descriptions that helped officers locate and detain him quickly. Diaz was last arrested by Fort Worth police on October 18, also for a DWI. This marks his second incarceration in one week.

Diaz now faces two counts of intoxication, assault, and collision involving serious bodily injury. The Fort Worth police department is continuing its investigation into the crash.
